By using our website at insulationcompanyalbany.com, contacting us for services, or entering into a service agreement with Albany Insulation, you agree to these terms and conditions. If you do not agree, please do not use our website or services. These terms may be updated at any time, and continued use of our site or services after an update constitutes acceptance of the revised terms.
Albany Insulation provides residential and commercial insulation services in Albany, OR and surrounding communities. Services include, but are not limited to, spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, wall insulation, basement insulation, air sealing, vapor barrier installation, and insulation removal.
All services are performed by or under the supervision of state-licensed contractors. We reserve the right to decline any service request that we determine is outside the scope of our capabilities, would create a safety risk, or would violate applicable building codes or regulations.
All estimates provided by Albany Insulation are based on conditions observed during an on-site assessment or information provided by the customer. Estimates are not binding quotes until confirmed in a written service agreement signed by both parties.
If conditions discovered during work differ materially from those observed during the estimate - for example, hidden moisture damage, structural issues, or hazardous materials - we will stop work, notify you immediately, and provide a revised estimate before proceeding. We will not perform additional work beyond the original scope without your written or verbal authorization.
Prices quoted are valid for 30 days from the date of the written estimate unless otherwise noted. Material costs are subject to change, and we reserve the right to adjust pricing if significant price changes occur between the estimate date and the scheduled work date.
Jobs are scheduled after a written estimate is accepted and any required deposit is received. We make every effort to arrive within the agreed-upon time window. If we need to reschedule due to weather, equipment issues, or other circumstances, we will notify you as early as possible and offer the next available appointment.
If you need to cancel or reschedule, please notify us at least 48 hours in advance. Cancellations with less than 24 hours notice may result in a cancellation fee to cover time and materials reserved for your job. The specific cancellation fee, if any, will be stated in your service agreement.
Certain spray foam insulation jobs require the homeowner and any pets to vacate the premises for at least 24 hours following installation. It is your responsibility to make those arrangements in advance. Albany Insulation is not responsible for costs associated with temporary relocation during the curing period.
Payment terms are outlined in your written service agreement. For most jobs, payment is due in full upon completion of the work unless a deposit or installment schedule has been agreed upon in writing. Accepted payment methods will be specified in your service agreement.
For larger jobs, we may require a deposit before scheduling. The deposit amount will be clearly stated in your estimate. Deposits are applied toward the total project cost.
Invoices not paid within 30 days of the due date may be subject to a late fee. Accounts remaining unpaid after 60 days may be referred to a collections process. Albany Insulation reserves the right to pursue all lawful remedies for non-payment.

Failure to meet these responsibilities may result in delays, additional costs, or cancellation of the project. Albany Insulation is not liable for problems arising from inaccurate or withheld information.
Albany Insulation warrants that all work will be performed in a workmanlike manner consistent with industry standards for insulation installation in OR. If a defect in our workmanship is identified within 1 year of the completion date, we will return to assess and remedy the issue at no additional charge, subject to the conditions below.

Except as expressly stated above, Albany Insulation makes no warranties, express or implied, regarding the services or materials provided, including any implied warranty of merchantability or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Albany Insulation's total liability to you for any claim arising from our services - whether based on contract, tort, negligence, or otherwise - is limited to the total amount paid by you for the specific service giving rise to the claim.
In no event will Albany Insulation be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of revenue, or cost of substitute services, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of consequential damages, so this limitation may not apply to you in full.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing any legal action. If mediation fails, disputes will be resolved through binding arbitration conducted in Linn County, Oregon, in accordance with applicable rules. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.
These terms and conditions are governed by and construed in accordance with the laws of the state of Oregon, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration under Section 9 will be brought exclusively in the state or federal courts located in Linn County, Oregon.
